What bird is this?

A visitor to my front sidewalk was very interested in the creatures living in the garden -- lots of chipmunks. Can anyone help with what bird this is?

It is either a falcon or a hawk of some sort. What part of the country do you live? Can you describe its voice?

It looks like a Sharp-shinned Hawk (Accipiter striatus)based on size.
