There's a robin in the lower left of the picture, which gives a size reference. What is the bird in the upper right? It's driving me crazy!! :D Photographed Jan 2016 in Victoria BC Canada

Extra info NEW

I know the pic is sort of hard to make out, but the mystery bird in the upper right is a speckly/black/white spotted color all over (breast, head, back) with dark patches on the cheeks and a short (non-woodpecker-like and non-curved) beak. Grippy little twig holding legs like a robin. A bit bigger than the robin.
